Russia Cancels Work Permits for Kazakhstan & Belarus nationals

September 2011 was marked by hot discussions and expectations of coming into force an Agreement on legal status of foreign employees and their family members between Russia, Belarus and Kazakhstan.

 
Facilitation of immigration rules is major purpose of Agreement
 

This Agreement was signed almost one year ago on November 19, 2010 in St.Petersburg, but still did not come into effect.

 

This agreement allows the citizens of Russia, Belarus and Kazakhstan to work in all three countries without obtaining a work permit.  The agreement provides that employers who hire employees, will be permitted to conclude labor contracts with them to provide a job officially.

 

Moreover, a foreign employee or family member will be exempt from registration within 30 days from the date of entry into the country of employment.

 

Currently, the Agreement has been ratified by all three states.

 

With regard to the Agreement coming into force, we should note that according to Article 22 of the Agreement, it shall come into force 30 days from the date of receipt of the Integration Committee of Eurasian Economic Community, the last written notification of the ratification of the Agreement by the parties.

 

At the same time from the information we received from the Integration Committee, the Agreement shall come into force on 1 January 2012, according to the Decision of European-Asian Economic Council from December 9, 2010 ¹ 65.

 

In most cases the new Agreement will be sufficient  for citizens of Kazakhstan and Russia in both countries, because citizens of Belarus are suspended from requirement to obtain a work permit to start employment in Russia on the basis of an Agreement between Russia and Belarus signed several years ago.

 

We do hope that Russian Immigration legislation will continue a tendency to be fulfilled by new regulations directed on improvement and facilitation of requirements towards foreign employment in Russia.
